1 General Information

These Delivery and Return Terms govern the delivery and return processes of software services (SaaS) provided by Orca SaaS Technology Inc. ("Orca SaaS", "we", "us"). By using our services, you agree to these terms.

Important: Orca SaaS is a software as a service (SaaS) platform. We provide digital service access, not physical product delivery.

Our services are entirely cloud-based and accessible from any device with an internet connection. You can start using the service immediately once your subscription package is activated.

2 Delivery Terms

Service Activation

Orca SaaS services are delivered digitally. After your payment is confirmed, your account is automatically activated according to your selected package and you get immediate access to the service.

Service Access

  • You can instantly access all features by logging into the platform through your web browser
  • Your account credentials are sent to the email address you specified during registration
  • Documentation for API access and integrations can be obtained from your control panel

Enterprise Package Delivery

For Enterprise package subscriptions, platform configuration and customizations may be required according to your specific needs. In this case, our customer representative will contact you to initiate the setup process. Once the setup is complete, training and onboarding support is provided.

3 Cancellation and Return Terms

General Return Policy

Orca SaaS prioritizes customer satisfaction and protects your return and cancellation rights under certain conditions. However, due to the digital nature of the service, some special conditions apply.

Legal Right of Withdrawal: Under distance sales contracts, you have the right to withdraw from the contract within 14 days from the date of the contract without giving any reason and without penalty.

Return Conditions

  • Exercise of the right of withdrawal requires that the service has not yet been used
  • Written notification must be made within the 14-day withdrawal period
  • Your payment refund will be made within 14 days of receiving your withdrawal notice
  • For annual subscription packages, proportional refund can be made for the unused period

Return Process

You can process your return request by following these steps:

  1. Submit your return request to our support team at support@orcasaas.com or through the platform
  2. Your return request will be evaluated within 2 business days
  3. For approved return requests, your payment will be refunded using the same payment method
  4. You will be notified by email when the refund process is complete

4 Right of Withdrawal

In accordance with Article 15 of the Consumer Protection Law, consumers have the right of withdrawal in the following situations:

14-Day Withdrawal Period

Within 14 days from the date the contract is established, you have the right to withdraw from the contract without giving any reason and without paying any penalty.

Exceptions to the Right of Withdrawal

  • For services that have begun with the consumer's consent, the right of withdrawal cannot be exercised if the service has been completed
  • The right of withdrawal does not apply to services performed instantly in electronic medium and intangible goods delivered instantly to the consumer
  • If consent has been given for the immediate start of the service when starting the subscription and the service has started to be used, the right of withdrawal does not apply for the used period

Exercise of the Right of Withdrawal

To exercise your right of withdrawal, you must submit a clear statement declaring your intention to withdraw to support@orcasaas.com email address or by mail to our address. In your withdrawal notice, you must specify your name, surname, address, email address, phone number and order number.

5 Payment and Invoicing

Payment Methods

  • Credit Card (Visa, Mastercard, American Express)
  • Bank Transfer / Wire Transfer
  • Online Payment via Virtual POS
  • Open Account / Check option for corporate customers

Invoicing

E-invoices are issued for all your payments and sent to your registered email address. Your invoice can also be downloaded from your account on the platform. Special invoicing options are available for our corporate customers.

Automatic Renewal

Your subscription will automatically renew unless you cancel it. You will be notified by email 7 days before the renewal date. You can cancel automatic renewal from your account settings at any time.

6 Responsibilities and Warranty

Service Warranty

Orca SaaS guarantees that the platform operates with 99.9% uptime. Scheduled maintenance is announced in advance and performed with minimum disruption. In case of service interruptions, compensation options are offered to our customers.

Customer Responsibilities

Customers are responsible for the security of account information, the legality of data uploaded to the platform, and compliance with terms of use. In case of platform misuse, the account may be suspended or cancelled.
